Welcome to Kitme.

These Terms and Conditions ("Terms") govern your access to and use of Kitme's mobile application, website, and related services (collectively, the "Services") provided by Kitme, Inc. ("Kitme," "we," "us," or "our").

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree with these Terms, you may not use the Services.

1. Eligibility

You must be at least 16 years old, or the minimum age required to legally use the Services in your jurisdiction.

By using the Services, you represent that:

  • You meet the applicable age requirement;
  • You have the legal authority to enter into these Terms;
  • All information you provide is accurate and complete.

2. Account Registration

Certain features require you to create an account.

You agree to:

  • Notify Kitme if you believe your account has been compromised;
  • Accept responsibility for activity occurring through your account.

You are responsible for maintaining the confidentiality of your login information.

3. Use of the Services

Kitme provides an AI-powered digital closet and personalized shopping experience designed to help you organize your wardrobe, discover products, and receive personalized recommendations.

You agree not to:

  • Use the Services for unlawful purposes;
  • Attempt to gain unauthorized access to the Services;
  • Interfere with the security, integrity, or performance of the Services;
  • Reverse engineer, decompile, modify, or create derivative works of the Services;
  • Scrape, extract, or collect data from the Services without permission;
  • Use Kitme to distribute harmful, fraudulent, or misleading content.

4. Third-Party Integrations

Kitme integrates with third-party platforms and services to provide certain features.

These may include, but are not limited to:

  • Gmail;
  • Ecommerce platforms;
  • Retailer accounts;
  • Marketplaces;
  • Other supported services.

By connecting a third-party service, you authorize Kitme to access and process information from that service as described in our Privacy Policy.

Kitme does not control and is not responsible for third-party services, their availability, or their privacy practices.

Gmail Integration

If you connect your Gmail account, you authorize Kitme to access purchase receipt information through Google's Gmail API.

This information may include:

  • Retailer names;
  • Product information;
  • Purchase dates;
  • Sizes;
  • Colors;
  • Order details;
  • Other receipt information necessary to provide the Services.

Kitme uses this information to:

  • Build your digital closet;
  • Organize purchases;
  • Provide personalized recommendations;
  • Improve your experience;
  • Enable additional shopping features.

Kitme only accesses information necessary to provide these Services and does not access unrelated email content.

You may revoke Gmail access at any time through your Google Account settings.

5. Personalization and Retail Partner Experiences

Kitme is designed to help you receive more relevant shopping experiences based on your preferences, purchases, and digital closet.

By using the Services, you authorize Kitme to analyze information you provide or connect to Kitme in order to:

  • Generate recommendations;
  • Create personalized shopping experiences;
  • Improve product discovery;
  • Provide relevant offers and experiences;
  • Facilitate interactions with participating retailers and brands.

Kitme may share certain personal information and shopping-related information with participating retailers and brand partners as part of providing personalized shopping experiences, recommendations, offers, communications, and related commerce services, as described in our Privacy Policy.

6. Commercial Relationships With Retail Partners

Kitme may establish partnerships with retailers, brands, and commerce companies.

These partners may compensate Kitme for providing access to:

  • Kitme's personalization platform;
  • Recommendation technology;
  • Consumer insights;
  • Analytics;
  • Retail integrations;
  • Marketing and engagement tools;
  • Other related services.

Partner access may include access to certain consumer information, including contact information, where necessary to provide the applicable Services.

Such relationships do not transfer ownership of your personal information to Kitme partners.

Your information remains subject to the protections described in our Privacy Policy.

7. User Content

You retain ownership of content and information you submit to Kitme, including:

  • Photos;
  • Closet information;
  • Style preferences;
  • User-generated content;
  • Profile information.

By using the Services, you grant Kitme a worldwide, non-exclusive, royalty-free license to use, process, reproduce, modify, analyze, and display your content solely as necessary to:

  • Provide and improve the Services;
  • Create personalized experiences;
  • Operate Kitme features;
  • Develop and improve Kitme technology.

This license includes the right for Kitme to process, analyze, and use information associated with your account and use of the Services to provide personalized experiences, recommendations, and partner-enabled features as described in the Privacy Policy.

You represent that you have all necessary rights to content you provide.

8. AI Features and Recommendations

Kitme uses artificial intelligence and machine learning technologies to provide recommendations, styling suggestions, and personalization features.

You understand that:

  • Recommendations are generated automatically and may not always be accurate;
  • Kitme does not guarantee that recommended products will meet your expectations;
  • AI-generated suggestions should be considered informational and not professional styling advice.

Kitme may improve and update AI systems over time.

9. Retail Communications

By using Kitme, you acknowledge that certain Services may involve communications from participating retailers and brands facilitated through Kitme.

Where applicable, Kitme may provide participating partners with contact information, including email address, to enable personalized shopping experiences, product recommendations, promotions, and related services.

Participating partners are responsible for complying with applicable communication and privacy laws, including providing appropriate opt-out mechanisms where required.

10. Fees and Payments

Certain features of Kitme may require payment.

If you purchase paid Services:

  • You agree to provide accurate payment information;
  • Payments are processed through third-party payment providers;
  • Fees are non-refundable unless otherwise stated or required by law;
  • Subscription terms will be disclosed at purchase.

Kitme reserves the right to modify pricing with appropriate notice.

11. Intellectual Property

The Services, including:

  • Software;
  • Technology;
  • Designs;
  • Logos;
  • Branding;
  • Algorithms;
  • AI systems;
  • Platform features;
  • Aggregated insights generated by Kitme;

are owned by Kitme or its licensors.

You may not copy, modify, distribute, sell, reverse engineer, or exploit any part of the Services without written permission.

12. Aggregated Data and Insights

Kitme may create aggregated, anonymized, or derived insights from information collected through the Services.

These insights may be used to:

  • Improve Kitme;
  • Develop products;
  • Analyze trends;
  • Provide services to business partners;
  • Improve personalization experiences.

Kitme does not disclose personal information in a manner inconsistent with its Privacy Policy.

13. Termination

Kitme may suspend or terminate your account if:

  • You violate these Terms;
  • You misuse the Services;
  • Your actions create risk for Kitme or other users.

Upon termination:

  • Your right to access the Services ends;
  • Certain information may be retained as required by law or described in the Privacy Policy.

14. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis.

To the fullest extent permitted by law, Kitme disclaims all warranties, express or implied, including:

  • Accuracy;
  • Reliability;
  • Availability;
  • Fitness for a particular purpose.

15. Limitation of Liability

To the fullest extent permitted by law, Kitme shall not be liable for:

  • Indirect damages;
  • Consequential damages;
  • Lost profits;
  • Loss of data;
  • Business interruption.

Kitme's maximum liability shall not exceed the greater of:

  • Amounts paid by you to Kitme during the previous six months; or
  • $100.

16. Indemnification

You agree to defend, indemnify, and hold harmless Kitme, its affiliates, officers, employees, and partners from claims arising from:

  • Your use of the Services;
  • Your violation of these Terms;
  • Your violation of third-party rights;
  • Content you submit through the Services.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York.

Any disputes arising from these Terms shall be resolved through binding arbitration, except where prohibited by law.

18. Changes to These Terms

Kitme may update these Terms periodically.

If material changes are made, we may notify you through the Services or other appropriate methods.

Your continued use of the Services after updates become effective means you accept the revised Terms.
